第一章总则
Chapter 1 General Principles
第一条为了规范国务院行政机构的设置，加强编制管理，提高行政效率，根据宪法和国务院组织法，制定本条例。
Article 1 With a view to standardizing establishment of the administrative agencies of the State Council, promoting administration of the establishment and staffing thereof and improving administrative efficiency., these Regulations are hereby formulated according to the Constitution and the Organic Law of the State Council
第二条国务院行政机构设置和编制管理应当适应国家政治、经济、社会发展的需要，遵循精简、统一、高效的原则。
Article 2 Administration of the establishment and staffing of the administrative agencies of the State Council shall adapt to the needs of political, economic, and social development of the State, and conform to the principles of simplification, unification and high efficiency.
第三条国务院根据宪法和国务院组织法的规定，行使国务院行政机构设置和编制管理职权。
Article 3 The State Council shall, according to the provisions stipulated in the Constitution and the Organic Law of the State Council, exercise the functions and powers of administration over establishment and staffing of the administrative agencies of the State Council.
国务院机构编制管理机关在国务院领导下，负责国务院行政机构设置和编制管理的具体工作。
The agency and staffing administration organ of the State Council shall, under the leadership of the State Council, take the responsibility for the specific administration of establishment and staffing of the administrative agencies of the State Council.
第二章机构设置管理
Chapter 2 Administration of Agency Establishment
第四条国务院行政机构的设置以职能的科学配置为基础，做到职能明确、分工合理、机构精简，有利于提高行政效能。
Article 4 The establishment of the administrative agencies of the State Council shall be based on the scientific al[] of functions and achieve a clarification of functions, rational division of duties and simplified structure to facilitate improvement of administrative efficiency.
国务院根据国民经济和社会发展的需要，适应社会主义市场经济体制的要求，适时调整国务院行政机构；
The State Council shall, pursuant to the needs of the national economy and social development and based on the needs of the socialist market economy, adjusts in good time the administrative agencies of the State Council;
但是，在一届政府任期内，国务院组成部门应当保持相对稳定。

第五条国务院行政机构的设立、撤销或者合并，由国务院机构编制管理机关事先组织有关部门和专家进行评估和论证。
Article 5 The agency and staffing administration organ of the State Council shall organize the relevant departments and experts in advance to appraise and validate the establishment, dissolution or merger of administrative agencies of the State Council is appraised and validated.
第六条国务院行政机构根据职能分为国务院办公厅、国务院组成部门、国务院直属机构、国务院办事机构、国务院组成部门管理的国家行政机构和国务院议事协调机构。
Article 6 The administrative agencies of the State Council are, pursuant to their functions, divided into the General Office of the State Council, the constituent ministries and commissions of the State Council, the agencies affiliated with the State Council, administrative offices of the State Council, the State agencies administrated by the constituent ministries or commissions of the State Council and the deliberation and coordination agencies of the State Council.
国务院办公厅协助国务院领导处理国务院日常工作。
The leaders of the State Council shall enjoy the assist of the General Office of the State Council in handling the daily work of the State Council.
国务院组成部门依法分别履行国务院基本的行政管理职能。国务院组成部门包括各部、各委员会、中国人民银行和审计署。
The basic administrative functions of the State Council shall, pursuant to law, be exercised the by the constituent ministries and commissions of the State Council, which include the various ministries or commissions, the People’s Bank of China and the Auditing Agency.

The constituent ministries or commissions of the State Council shall administrate the State agencies administrated by the constituent ministries or commissions of the State Council, which shall take charge of specialized work and exercise administrative and managerial functions.
国务院议事协调机构承担跨国务院行政机构的重要业务工作的组织协调任务。

第七条依照国务院组织法的规定，国务院设立办公厅。

The agency and staffing administration organ of the State Council shall bring forward the proposal of the programmer for the establishment, dissolution or merger of constituent ministries and commissions of the State Council, which shall, upon the discussion and adoption by the Executive Meeting of the State Council, be submitted by the Premier of the State Council to the National People’s Congress for a decision.
在全国人民代表大会闭会期间，提请全国人民代表大会常务委员会决定。

第八条国务院直属机构、国务院办事机构和国务院组成部门管理的国家行政机构的设立、撤销或者合并由国务院机构编制管理机关提出方案，报国务院决定。
Article 8 The agency and staffing administration organ of the State Council shall bring forward the proposal of the program for the establishment, dissolution or merger of directly subordinate agencies of the State Council, administrative offices of the State Council, and the State agencies administrated by the constituent ministries or commissions of the State Council,, which shall be submitted to the State Council for a decision.
第九条设立国务院组成部门、国务院直属机构、国务院办事机构和国务院组成部门管理的国家行政机构的方案，应当包括下列事项：
Article 9 The following items shall be included in the programmer for the establishment of the constituent ministries and commissions of the State Council, the agencies affiliated with the State Council, the administrative offices of the State Council, the State agencies administered by the constituent ministries or commissions of the State Council:
（一）设立机构的必要性和可行性；
(1) The necessity and feasibility for establishment of agencies;
（二）机构的类型、名称和职能；
(2) The types, titles, and functions of the agencies;
（三）司级内设机构的名称和职能；
(3) The titles and functions of internal institutions at the departmental level;
（四）与业务相近的国务院行政机构职能的划分；
(4) The division of functions between the administrative agencies of the State Council whose administrative work is closely related;and
（五）机构的编制。
(5) The staffing of the agencies.
撤销或者合并前款所列机构的方案，应当包括下列事项：
The following items shall be included in the programmer for dissolution or merger of the agencies listed in the preceding paragraph:
（一）撤销或者合并的理由；
(1) The reasons for dissolution or merger;
（二）撤销或者合并机构后职能的消失、转移情况；
(2) The status of the disappearance and transference of the functions after dissolution or merger of agencies; and
（三）撤销或者合并机构后编制的调整和人员的分流。
